Registrar emails consider spam

I have had regisrar emails go to spam and therefore effecting the ability to rely on renewal reminders. I understand that ICANN make it a contractual duty of the registrar to contact the registrant prior to dropping the domain name. If the registrar is aware (thorugh previous reports) that the emails go to spam and they do not make it clear as part of registrant conditions that such circumstances are likely to occur....if the name then drops can you sue the registrar for breach of contract?

I am looking for similar case studies and in particular where you reported that emails are going to spam.

I would flip it the other way round and say that it's your duty to ensure that your spam filter is effective.

Effective not only means stopping spam but also means not stopping legitimate emails. If yours stops emails that it shouldn't, then you can change the settings, whitelist the registrar, get another spam filter or turn it off.

I'd say that the registrar fulfils their duty by sending the email. If your spam filter stops it and you don't see it, that's your look out.

I don't think it's realistic to throw it back to the registrar - they surely can't legislate for every combination of spam filters out there, every combination of settings and every update made thereto.

I can't see this one having any legs, but you never know!
 
Not settings

I am not talking about settings I am more interested in whether such companies have been included in a spamming list, On what basis do they make the initial spam list...ie. Yahoo?
