Selling domains - contract of sale?

Hi

Just wanting some opinions from some experienced domain sellers (or indeed buyers)...

When you sell the domain, do you have any sort of contract in place between you and the buyer?

To be more specific - and where you do have a contract in place - have you ever used a clause whereby if the domain is resold and/or transferred within, say, two years then you are entitled to a further percentage of the consideration of that second sale/transfer?

This sort of thing is common when buying/selling land and I was wondering how prevalent it is with domains....

Never used a contract, rely on trust and checking out who you are dealing with (no webmail only emails accounts / PO Boxes).

Anyone else had any experience of using contracts?

When its a .uk domain you pay the £35 transfer fee to Nominet to make it official.

How do you handle .com sales. Who is the regulatory body for change in ownership?

You shouldnt really need a contract for a simple domain name sale, you agree in an email or letter a price and method of payment, and you agree who pays the transfer costs and that is then a contract between you and the buyer.

If you're selling a brand name or trademark domain name you might need to consider a proper contract drawn up then or at least a disclaimer so that you're not legally liable if the buyer gets sued and decides to sue you.
