As someone quite rightly pointed out, the EMD update was all about assessing the quality of the site found on EMDs. It was never a penalty simply for being an EMD. They can rank as well as ever, just need to be much higher quality... under the scrutiny of G
 
The biggest problem with the EMD update is that it raised the bar only for EMDs, allowing poorer quality pages to replace them in the SERPs in some instances.

My understanding of EMD was that there used to be an unfair advantage for EMDs, Google took that away so all domain are on the same playing field.
 
I'm not do sure. EMDs still rank really well, even fresh ones. Sure they may have tuned things down, but sites that were wiped out in that update were done so as they failed to meet the quality threshold of their filters when closely examined. It was a focus on EMD with penguin etc style filters applied.
