When a buyer doesn't accept the NOM request.....

Not too sure if this is in the correct section (if it isnt, apologises, and can a mod move it please....)

Just wanted to know what others do when you get the inevitable buyer not accepting the Nominet transfer request, most likely because they dont want to pay the transfer fee......

Example.

AD clearly states that buyer will be responsible for NOM fee

Buyer purchases xxxx.co.uk

Buyer pays for domain

Buyer requests that the transfer be made via the registrar first, in this case GODADDY, on the proviso that they will then accept the NOM transfer request

After receiving the name via GD, buyer then, seemingly, ignores all correspondence from seller and nominet

Seller sends one last email stating that buyer will receive one last request from NOM to transfer, and if this is not accepted seller will delete domain from their account


After this happening, I was just a little concerned that if I deleted the domain, the buyer would have the right to come back and try and state that they had been away and not seen the requests, and thus demand for their money back.......

Just wondered what peoples thoughts were on this, as it happens a few times, and what length of time do you give buyers to accept the transfer request? and how many times?

Simple answer: NEVER "transfer" domains via a registrar (since they're not legally transferred anyway, that only changes certain management aspects). Transfers via Nominet are the only types of transfer that will change the LEGAL OWNER and as such there shouldn't be an issue for any buyer to work within the system.

If you explain the situation clearly enough, legitimate buyers should see the sense in what you're saying. Especially if you explain that it's "not like .com" in that a registrar push will do nothing at all to the legal ownership of that domain name.
 
Thanks for the reply, will certainly bear that in mind for the future, however in this circumstance, would you say I was in my right, after sending several reminder emails and 2 nom transfer requests, to simply delete the domain?

No, not unless you refund the money first.

Apart from the time factor, Nominet transfer requests cost you nothing, as Nominet will refund them if they expire.

Best solution would be to ask the buyer "Which account would you like your payment refunded to?" and that should either prompt them to actually get a move on and transfer the domain, or it will get you off the hook with that particular buyer and leave you open to sell the domain to somebody else.

Depending on the value of the transaction, I'd even consider renewing it. Perhaps not for £xx (follow Sean's advice) but for £xxx and up it's worth a renewal fee with a blunt warning that you won't renew it again. I've done that on a couple of occasions over the years.
 
I have had this problem, I will only reinitiate the transfer twice and both times I inform the buyer that I have initiated the transfer.

If they don't accept on the 2nd attempt then I simply leave it and wait for them to contact me, if they then don't accept the 3rd time round then it's tough.

It's like if you poay for an item in a shop and don't collect it and then get plenty of reminders but still fail to collect the item then the shop are intitled to resell the item.

A trasnfer gives you 5 days to accept and only takes a few minutes to for the buyer to do so if they can't do it then well it's there fault.
 
I send two requests for free, on sending the second request I inform the buyer that any further requests will be charged at £50 + VAT, this usually works!

Be careful - I'm not sure the law agrees with you (the law and common sense are often at odds)
 
If the buyer has paid you but has not accepted the Nominet change, they will most likely come back at some point to ask you for the name. No need to delete the name. How would you like e.g an online store to 'delete' your item just because you didn't come to collect it? :) They'll still be liable to refund you. If you delete the name and somebody else registers it, I think you will have to refund the money to the buyer .... so don't lose your domain and the sale amount. Wait for the buyer.

I don't know why you would even compliment deleting it? what harm is it doing sitting in your nom account.

Just wait.

I think if you're saying you would delete it, it's an admission it's not worth anything.

If they have access to it, they could potentially upload any uncooth content, and the name on the record is yours.

Im actually in this situation my self, and ive been chasing the buyer up for ages now, too long infact (I think they have either changed email address or just doesnt bother to read my emails because ive not had a response for some time, which had made me get intouch with heart and ask them to get in contact with them on my behalf. I also urged them to make it clear if its not sorted i will delete the domain name). Not heard back yet!

At first they asked me to make the transfer which i did but they just kept letting it expire and always had some kind of excuse for not completing it.

Ah, good point, I should have read the post more clearly.

I shouldn't be on here today, haven't slept and I'm just typing out cr@p.
 
If someone was to put compromising material up then just log onto your nominet account and pay £12 to change the TAG back to your own host so you can repoint the name servers.

and as it turns out my buyer has finally accepted the transfer, so alls well that ends well....

Though have learnt a few lessons.......

One that I now need to take heed of with a new sale, lol.........!
 
Had an email from the buyer today! stating heart had been intouch and they would like to complete the transfer. Sent it across and BINGO its complete!!!!!
