Does it annoy anyone else that someone can purchase a domain on a buy now basis from sedo and then not pay.
Sedo do at some time, after the payment default, give the seller details of the fraudulent buyer, but these details are normally scant or even totally fictitious.
Would it annoy you even more if you later discover that sedo were able to get their commission paid by the buyer and not ever inform the seller.

The last 2 BINs the seller didn't comply and supply the domain to me.

Buyers and sellers default, nature of the platform.

Should have harsh penalties, bans.

But at least a seller is easier to identify.

The point I make though is that sedo go on to get their commission which then distorts the contractual amount the buyer owes. Sedo do not inform the domain owner that commission has been paid, so consequently after tracking down the buyer , which can be very time consuming, any legal claim by the seller against the buyer is immediately flawed.

I sold a .com through Sedo and the buyer (Australian) wanted a custom contract, payment terms and all sorts of other things which the Sedo broker arranged. Altogether the negotiation went on for around five months and after all the hassle, they never made the first instalment and refused to respond to any attempts at contacting them. A huge waste of time for everyone.

Like Garth says, it's the nature of the platform. Don't waste energy dwelling on it, move on.

Was it a buy now?

Did you ask sedo if they were paid their commission ?
I have never asked, I only found out when the fraudulent buyer informed me that he owed nothing because he had paid the commission.

No it, was a negotiated sale where the price was increased in return for staged payments. I never asked if Sedo got paid the commission but to be fair they drew up bespoke contracts and put in a lot of legwork so in my case they would have deserved it.

Have you asked Sedo to confirm they were paid commission? It could be that the buyer is bullshitting you to try and justify their behaviour?

Sedo confirmed they DID receive the commission.
When asked how one determines the amount of the claim relating to the breach of contract ,which exists on a buy now agreement, where they have collected their commission, they did not respond.

List your names elsewhere, starve their platform of inventory.

The reason I am not currently of the opinion that that is the answer is because. If the"buy now" option on sedo was operated correctly there would be no problem in sales going through.
If a potential purchaser paid at the point of purchase all would be as it should be.
Why do so many "buy now" purchases fall through ?
Why do sedo collect the commission, and not inform the seller ?
How many sellers has this had a detrimental affect on in the past who were oblivious the fact that sedo had been paid a "get out clause "commission ?

On my two failed purchases, I received a full refund.

So how is Sedo taking a commission?

How do you know if they pursued the seller for a commission.

after all they can hardly punish the buyer when the seller pulls out.

Can't, but I doubt a non complying seller would pay a commission demand. You can ask, getting it is another.

Read the terms you're signing up to, the fine print. Don't like them walk.

Or get them changed.

Not sure here though that even if sedo do not contravene the letter of the agreement they do not seem to adhere to the spirit.

I have already withdrawn my names from the "buy now" it is simply disingenuous.

I have, for now anyway, left them on a bid basis and will try to get to the bottom of why they can chase a fraudulent purchaser for the commission and fail to inform the seller that they have been successful.

It now transpires that sedo collected their commission only 23 days after cancelling the transaction quoted below.

qoute"Transaction cancelled by Sedo mar/05/13

Despite numerous reminders and warnings sent to the buyer, he did not make the payment.
Sedo will therefore not proceed with the transaction at this point.

Since the buyer has failed to fulfill his part of the contract, you may take legal action against him. His contact data are now available in your Sedo contract.

The suspension of the transfer does not affect the Purchase & Sales Agreement between you as the seller and the buyer. In case you agree with the buyer to continue the transaction, Sedo may proceed with the transfer." end of quote.

Sedo collected their commission from the buyer 23 days after this on the 28th march 2013 but never informed me as the seller.

After nearly 2 years?

These things can take time and it is a cast iron case .

But look this is about
Sedo took an order for a co.uk sale, they then cancelled the sale for non payment, and passed on to me scant details of the buyer, no email or phone number and just an initial for the Christian name.
They advised me that I could chase the buyer for breach of contract.
I tracked down the buyer and chased him for payment only to find out 20 months after the event that the buyer had paid the commission, affidavits of course will determine the events at the time.

Isn't this just a case of Sedo doing a better job than you at getting their money out of the guy?
