Our domains manager (Dan) is currently working with Nominet to track down exactly what happened here and what's gone wrong. Hopefully we can get to the bottom of it but it seems definitely like there's a loophole of some kind in Nominet's system to allow this.
We have registered a lot of .uks for people where the .co.uk is not with us, mainly in circumstances where they're with a registrar that wasn't ready or set up to handle the .uk registrations. Nominet will allow it as long as all of the registrant details including the email address match...

We are charging the same for .uk as we do for .co.uk (£4.49 plus VAT for single year, £2.79 plus VAT per year for two years or more).
Just as a caveat, make sure that whoever you do register with doesn't charge for transfers out - there are a few that do now which is a shame.
