No the point is both tags are not 'real' tags - they are used by a catcher to circumvent Nominet's rules about quotas. The only way you're realistically going to get any response is to make an offer via the domain.

I got told @Hay ws using a few tags and has got banned by nominet. never got a reply

If he was banned by Nominet, you'd expect the domain he owns to them be forced cancelled, so maybe that's not the case, but you could be right...

Not necessarily. Someone could be banned as registrar or member but this shouldn't affect their registrant status. In fact the registrant could be different.
