A friend of mine has just purchased a domain name...

Lets say brandnewferraris.co.uk (it's not this, but the same concept applies)...

I thought this type of name would be a trademark infringement on "ferrari", but he's adamant it isn't.

Simple question - Would a name like this be allowed?

Thanks,

No, unless he's a dealer (in the car in question) in which case it depends.

That's what I thought, thanks.

What if he wasn't a dealer, but owned a couple of ferraris (i wish this wasn't just an example) to sell on the website?

Doesn't matter. All the value in the "ferrari" part of the domain name has been created by the branding efforts of Ferrari (the company) so he's trading off that if he registers a domain that includes their name.

I can tell you ferrari WILL hunt you down, and they will require payment just to go away. Their legal people are like pitt bulls and everyone is an example.
