Despite Marshall never having profited from the domain, however, sole WIPO panelist Tony Willoughby pushed the rules governing domain name disputes as far as they could go to find for Rooney, claiming that he didn't believe that Marshall would have posted a non-commerical fan site had he ever decided to put a site up.

How can Willoughby be involved in .com decisions and .co.uk decisions at the same time?

For example could he have been the expert on WayneRooney.com and WayneRooney.co.uk?

Or did they get Andrew Murray to do the .co.uk because he can say:

I formally confirmed to Nominet that I knew of no reason why I could not properly accept the invitation to act as an Expert in this case and further confirmed that I knew of no matters which ought to be drawn to the attention of the parties or which might appear to call into question my independence and/or impartiality.

I get this growing feeling that you are guilty until you provide evidence to the contrary...surely this is against our legal system?

DRS should be based on FACTS not personal opinions or guesswork. Nominet should do something constructive and give it to the Patent office to deal with based on strict TM laws.

I don't really know anything about these laws or this case at all to be honest, but I did have a question about this:
"A ruling was made that the domain name must be handed to the Manchester United striker and his management company". - Quote from BBC News website.

So my question is this. If another person with the name Wayne Rooney came forward and said they should get it - who would get it?
Surely they couldn't just give it to the famous Rooney because he is famous or has better legal representation?
