Hi All
I have a client who has a trademark in place on their company of which someone else has registered the domain name and they want it back, they are looking to hire someone to carry out this on their behalf.

Have they approached the domain owner asking for it? I would suggest using a solicitor if going down the drs route.

So they have owned it before the other party regg'd it?

They only can claim it or even think to be able to claim it if the other party is using it in the same area. Selling phones and Selling phone accessories.

e.g. I could own orange.co.uk and sell orange juice and the phone company couldn't do a thing so to speak.

When you say they wish it “back” did they own the domain previously and let it drop…?

Have had a few DRS last was with a magic circle legal firm and to be honest apart from trying to blacken our name accusing us of every thing from being in cohesion with there registrar, inside knowledge, intercepting emails, Kennedy assassination..? all a load of tripe, There case was abysmal, complaint was 97 pages long, Strategy sling as much muck as possible hope some sticks or bore you into acceptance...?
Vast majority of drs is common sense, Through in luck of the chosen "expert" to here your case...?

Trademarks can help but depends on class, use of site, trading years, how generic the term etc . It's a big list... I would suggest making an approach to the current owner via a third party if your worried about the responce..

Why if they had registered the trademark did they not register the name... Was it already gone now they want it..?
