Ive had this myself in the past with a large US rock bands management company. They know they will get no where by asking ebay to remove counterfeit items so they target affiliates listing those items instead. But Nominet should not be allowed to shut down sites over this.

It's ridiculous. eBay affiliates can only show what is listed on eBay. If rights owners use the Vero system - http://pages.ebay.co.uk/vero/ - they can have eBay listings taken down in minutes.

I think the thing is the Police don't understand it all, which is fair play you can't expect them to know it all off the bat, but Nominet need to look into these things and give guidance to the Police's requests. Or maybe the Police gave Nominet the wrong details of the situation.

I reckon it's a one off and some people got a bit ahead of themselves, I'm sure once the issue is raised with Nominet at the correct level it won't happen again.

I'd put it down to a misunderstanding all round rather than a widespread policy decision.

This also happened last year when loads of aff sites on .uk and other tld domains were closed down, it was to do with Ugg boots that time and the selling of what were deamed counterfeit boots, despite at least one person I read about being an official seller for Ugg themselves and they were also closed down by the police/Nominet.

Nice! Nominet didn't shut eBay down though, did they, and neither did the Police. Bollocks, pure bollocks!

There's something wrong in this country when a court order isn't needed to close down people's businesses. As for the e-crime Unit, they know very well how these things work GW, i cannot believe their discussions with Nominet didn't highlight to them how these things work either.

Didn't they do most of them for not having the correct address on the whois, but those were not aff sites they were actually selling them direct as far as I am aware.

Well Nominet should have asked and I think they will once this gets highlighted to the right person. As for the Police understanding how it works, not all of them do. The e-crime unit might be focused on the big scams and got blinded into that train of thought.

I think it's very possible that the officer dealing didn't understand the affiliate model or didn't check out the complaint from the compalinant before acting.

I still think this situation is cockup and not policy, that's my view on it anyway.
