Halting Spam

I've just threatened this lot with the £250 an email spam payout available in the UK, please feel free to do the same if they're hassling you as well.

Hi Lee - What's the £250 payout scheme? Is it some legislation that's passed me by? I just tried to Google for it and drew a blank, but it sounds like it might be something interesting to know - Cheers, Nick.

I think it was a couple of months back, someone did a private law suit and took a company to the small claims court over some spam regulations - the company was asked to sotp bu individual but they didn't, apparantly it's no big deal to the company even when asked to stop with £250 but if hundreds started doing it, it would bankrupt most if found guilty.

I saw it on the BBC news.

Lee are you referring to the Nigel Roberts case or another case?

The Nigel Roberts case settled the amount due out of court at 300pounds but therefore doesn't have the court decision behind the value of damages due. I am very interested in hearing of any other cases you know about as I am currently taking a case myself.

The regulations involved are The Privacy and Electronic Communications (EC Directive) Regulations 2003 and the Data Protection Act.

Lee - Ah yes - that rings a bell now.

From commercial systems I've seen, bluechips are very keen to make sure any opt-outs are in place on every email sent, and the opt-out systems function. Can't remember why, but I think they are exposed on either the DPA or some FSA-related legislation if they get complaints.

Also - they were rather keen to ensure their spam-lists were cleaned by the Email Preference Service: http://www.dma.org.uk/content/Prf-Introduction.asp

As an aside, if you saw the story about the suspended postie who was telling his customers how to stop him delivering junk mail, I understand that the two things you can do are i/ sign up to the Mail Preference Service to deter directly mailed crap (above), ii/ for unaddressed crap, email your address and request to opt-out to [email protected].

Down with unsolicited marketing crap!

im a huge fan of BoxTrapper ( available on CPanel )
requires senders to verify email address before mail is delivered ( they only need to verify once )
