if someone lies in negotiations who they are and what they do etc does this make an agreement void even if an offer has been accepted?

Tough one really as if you are the buyer of a domain name relating to your business, it is not in your interest to declare your business interests, as this will obviously inflate the price from the seller.

I have experienced this first hand. Eg I have seen names posted on acorn for £100 and then a week later I have made a thread saying looking to buy names upto £xx,xxx and people have emailed me the same names but for £1000 !

It's a bit low to deliberately mislead you as to the identity of the buyer, but some people are up to all sorts of tricks. You can't blame people for trying to get best prices for domains, or to buy for the least cost, but its out of order if people resort to lying or other underhand tactics.

When you sell a domain on Sedo, once you've got an offer and an acceptance of that offer, a contract (transfer agreement) is automatically generated by Sedo.

This contract governs the sale and unless there's something in there about telling porkies during the negotiation then whatever was said during the negotiation is irrelevant.

Having said that, it is usual to put in a contract words to the effect that the contract contains all terms and that nothing else is valid (eg verbally at the time of signing). The Sedo one contains no such term.

The Sedo thing also says that it's subject to German law - so maybe if you can find a German lawyer they may be able to shed some light on it.

But in general I think it's a case of hard cheese

Easiest way is to ignore anything the potential buyer tells you (whether via Sedo or direct via email) that's intended to affect the way you look at their ability to afford a given domain name. Price the name in a "black box" i.e. without taking who the buyer is into consideration, and you minimise the risk of seller's remorse afterwards.

If it bothers you that much then I'd just write to Sedo telling them that the seller lied. In the email I'd explain that you'd like to cancel the deal as you feel that the buyer actions have undermined your confidence in their ability to complete the transaction honourably and you'd rather not deal with people who conduct themselves in such a way.

They might ask you to pay the 10% commission, but they'll not ban your account unless you make a habit of it - that's my understanding of it anyway. Possession is 9/10 of the law and all that.

Lol, didn't say that it did bother you, I was just asking too! I was just saying that you probably don't have to sell if you don't want to. I'd say that about half of the deals I agree on Sedo are never completed by the buyer, and they don't appear to get banned for it.
