Problem with this case is that they didnt turn up at the hearing. All they have to do now is get the Judgment set aside and defend it,which they are doing.
Another thing not mentioned, if you have overdraft it is repayable on demand, so bank could turn nasty if you are overdrawn and complain,as usual banks have most people by 'goolies'

Although if the charges cover the overdraft Then it would be a case of clear the overdraft and close the account.
I read that the banks charges are in fact illegal or rather they cannot be legally upheld...and that the OFT is planning on getting rid of these charges anyway (banks and creditcards) within a year or so as they are unfair charges. I mean 30 quid for going over by a pound is ridiculous. :/
But on the other hand, i can't see why the contract you sign that contains the details of charges can't be upheld. Although there is the issue of unfair contracts.
