Question regarding .uk right to register

Hey,

Say a .co.uk is suspended and likely to be drop catched (premium domain that is a generic single word) and the .uk is yet to be registered, does the new owner (who we will assume drop catched the domain) have a legal right to the unreg'ed .uk? Or is it a first come first served basis?

Probably a stupid question, but would like some form of clarification or feedback on this please.

When a .co.uk drops, the .uk is released and is sometimes caught with the .co.uk by one or two different catchers, if the .uk is not regged, you are free to hand reg it.
