Thanks - that does seem silly when the non-hyphenated is not even in use, whereas mine has thousands of visitors a week and a proper website on it.

No, Nominet's proposed "use" test is what's silly.

It should be all or nothing. Either owning a domain name gives you rights, or it doesn't.

Otherwise it's just a line to be kicked back and forth in the sand by lawyers.

The DRS process is available to anyone who believes they have a right to a particular domain name, and by and large it works quite well (especially compared to the UDRP). So if you think your hyphenated version gives you rights to the unhyphenated one, then DRS the owner. If it doesn't, then why should .uk magically give you a free pass?
 
I'd switch that and say why should that person get the trumps over me? I'd happily go straight to an auction over the name, but rightly feel a bit peeved if he's just gonna get free dibs on another name he isn't going to use.

You may find this position paper interesting. I personally feel .uk will create confusion and it does not matter how well its managed - .uk domains will be registered by users who possibly are not the rightful owners. for e.g. who will register bank.uk (Barclays or HSBC or Nationwide ...etc) It would create more confusion than solve probelms. Plus the added cost.

I found the attached paper very helpful as it gives a detailed view of the upcoming .uk release.
