Has anyone got any info on buying a business name which is in administration ?

Is it possible to buy the name without the liabilities and such ?

Whats involved ?

Where would I start ?

I can't get the business name I want as its similar to nearly 15 others, but one of them is in admin so I want to buy the business name :)
 
Contact the administrators... but you'll find it might cost a lot to buy as their time is costly and they will want to try and sell the whole shebang to you or nothing. They will probably also be trying to save any jobs, I doubt you'll want all that hassle for the sake of a business name.

Also, remember that liquidation is no good either as all other assets are sold but the business name is deemed unusable for a number of years after such an event (better check that as it may be a ban on involved people using a similar/same name - but you said there were many similar names which stop you from registering a new company with the name you want anyway...)

Might not be easy but could be that the company has other assets you would like.
 
I kinda expected them to try and sell me the works but its only really the name I'm interested in.

As far as I gather there are many issues with previous directors being directors, and there maybe a time where its use is prohibited, but there is no other way to get a business name with the word(s) I want unless I go for word + totallyrandom madeupwords limited.

So annoying that for example inbound, inbounds, in-bound, in-bounds, inbound uk, inbound.co.uk, inbound.uk, inbound.com are all deemed the same, so only 1 person can have that.

I wanted 2 words but sooo many people registered names before the rules changed to be this strict, that buying the company name now and waiting for it maybe my only option :(
 
I did try this once.
The liquidator wanted £xxxx.
I was offering £xxx.
Liquidator had the attitude that it wasn't worth his time speaking to me (presumably due to his hourly rate).
 
I'm prepared to go into X,XXX but the company handling it haven't even replied to my email and companies house are being evasive for some reason.

They told me multiple times once the name is dissolved I can re-register it, even tho I told them there are a dozen similar it was only when I got shirty and broken my questions down into child-like form.

I am assuming its possible to obtain rights, so my next question was who can restore a company and how is a company restored under its original name ?

A dissolved company can only be restored by one of the following;

•any former director, member, creditor or liquidator
•any person who had a contractual relationship with the company or who had a potential legal claim against the company
any person who had an interest in land or property in which the company also had an interest, right or obligation
•any manager or trustee of the company's former employees' pension fund
•any other person who appears to the Court to have an interest in the matter


If a company is being restored and their old name is already registered by a new company, the old dissolved company being restored would have to change its name.

Assuming I was able to gain a place at the table, I am assuming my role would beed to be the above bold part.

They chose to ignore the other question which was "at which point in the process does a company lose it rights to the name, other than fully dissolved".
