Yes if the provider's T&C's override the Nominet T&C's, this is what the domain expiry policy group were discussing and Nominet were asking for feedback on during the summer (there were several discussions on this and other forums).
Personally, I think it is wrong and the registrant should retain the benefit of the domain or it should be detagged if the providers don't want to continue service if renewal is not completed. As to what happens, I guess it depends on the feedback Nominet got from the consultation.
