I sold a domain a few years ago. There was a sales contract that stated it was xxxxx.co.uk.

During the initial transfer they for some reason left me as the registrant but changed the tag. Essentially I have no direct control of the domain now through my Nominet account.

Despite numerous attempts at transfer - and a couple of attempts to broker the domain for third parties who have contacted me through the whois - they haven't changed the registrant though they want the domain but haven't done anything with it.

So, with .uk coming up, and it being a decent domain, what would you do? As I'm still the registrant and I specifically sold the .co.uk, would you claim the .uk?
 
No. Legally you're not the registrant as they've paid for it. The fact that they flunked the transfer is utterly immaterial.
 
Agree with Edwin. In law you are not the owner, you know you've sold it, and they know they've paid for it.
 
But did they pay for the .UK at the time? :D

I know.. I know..
 
Apart from the legalities it is a question of honesty and fair play.
