Sold domain, but WHOIS/nominet not transferred over.

The domain tag was changed, but the whois/nominet details weren't transferred.

who "owns" it, who can renew it?
 
The tag-holder has full control of the domain - is it on a private tag ?

Legally, do I own it, or does the person i sold it to own it?

You are the official registrant, but you no longer own it now you have accepted payment for it and it has been transferred to their tag. I see it as a bit like a V5 document on a car, where the registered keeper is not necessarily the same as the owner of the vehicle (i.e. the person who has paid or is paying for it).

I remember seeing a DRS case a while ago where a domain had been registered to the name of a web designer instead of the actual owner. Needless to say I'm pretty sure the owner (who wasn't the registrant) got the details updated.

It would be wise for the new person to get the registrant details updated though, as I personally wouldn't want my name on something I now have no control over. If they have it under their tag and control, they will be able to send a Nominet transfer to themself to do it (just needs the admin email updating if it hasn't been already).

Rightly nailed WB.

Nobody in their right mind is going to be agreeing to 'Nominets declarations of ownership' to even start a control process. knowning the declarations to be untrue, tantamount to fraudulent representation.
