just had some random bloke phone me up with the old hand it over or i'll come down on you like a ton of bricks job..

he's going to 'udrp the shit out of me..'

ironically its a pretty average .org.uk domain - he has the .com

to be fair he does have it tm'd under a lot of classes at ipo that it 'could' be used for..
 
Once this happened to me over email and it is amazing how abusive a company owner can be. He really said some disturbing stuff about knowing where I lived and coming to sort me out.

In the end I did some stalking of my own and found out the shared offices he was working from and I threatened to email the owners his emails and also pass them onto his local police. He was soon saying how sorry he was :D
 
Good luck with that - spooks me when people get upset like this. Usually once you get to have a chat things work out well and you might even develop a decent contact out of it if you stay professional and behave reasonably.

Happened to me once - the reminder that

A) I had registered the domain years before his TM.

B) 'Over-Reach' is an offence under his TM agreement and sufficent grounds to get his TM cancelled.

was sufficient for him to back-off

* only you know the grounds your sitting-on. I certainly wouldn't be willing to play 'rough and ready' if I thought I was in the wrong
 
The interesting thing is he's got some very nice domains, so knows his stuff I would say. He says he was turned over with a very similar domain and biz which is actually a household name now and 'its not going to happen again!'

As I usually find with these conversations, they start off nicely then as soon as they realise you won't transfer it they get very shitty, very quick. There was no discussion of prices or a sale even.

I've done nothing with this domain for four years but I did start developing it and left a sort of mini site/holding page which unfortunately is similar-ish to his new business .com

an example would be:

he owns nationalbank.com, I nationalbank.org.uk both generic but he's obviously tm'd it under good and services classes such as credit card services, banking etc.

Have fired it over to me solicitor so will will let you know what the score is on monday. :twisted:

Some very stange stuff goign on at moment with phone calls about domains then nowt - not sure if its coincidental feels like i'm being probed.. :)

Why do you publish a telephone number that you answer yourself? A wonderful way to provide a telephone number is to publish one that goes straight to an answering machine, without a pre-recorded message. They just get a beep and then realise they have to leave a message or hang up. The message is then emailed to you as a .wav or .gsm. It's a great way of putting people on the spot and then deciding whether and when you wish to call them back. I would always elect to call people at my own convenience so I'd always be ready with what I want to say. Much better all round.

this is wot I have, an 0845 number which costs about £6 per month to run, is setup to go straight to voicemail. If they leave a voicemail it gets emailed to me, and I can redirect the number to any number I want to, great for 'screening' any calls
 
Even freakier when people turn up on your doorstep about domains you own/owned thru companies etc lol. I've only (touch wood) had people trying to do business with me in the claims sector.

Just record any calls/log emails from the person and if anyone makes any serious threats go to the police... the root cause might be a civil matter but the moment someone steps over the line into threats its a criminal matter. If they are acting on behalf of a company that means you can nail them legally as an individual and their company. Remind them of that fact.
 
When we were involved with gambling domains we used to get this type of call mail parcel etc on a regular basis mainly yanks the occasional brit simple if they want it either negotiate cool if not udrp otherwise not interested

You can call your local police here are some of the things they can do ( this has a diverse effect on them to as udrp etc don't take the side of someone who is about to be prosecuted for an offence involoving the name to kindly)

messages e-mails, phone calls etc cause the victim to fear that violence will be used agaisnt them then the police can choose to charge the offender with an offence contrary to section 4 of the Protection from Harassment Act 1997

Under section 1 of the Malicious Communications Act 1998 it is an offence to send an indecent, offensive or threatening letter, electronic communication or other article to another person and sections 85 Postal Services Act 2000 or s127 Communications Act 2003

If the offensive or threatening letter, electronic communication or other article is racialist in nature or motivated by religious hostility then charges could be brought contrary to sections 32(1)(a) or 32(1)(b) of the Crime and Disorder Act 1998 . In serious cases offenders could face up to 7 years imprisonment.

You can do Civil precceding of you don#t want the police involved Section 3 of the Protection from Harassment Act 1997.

These may have been updated as its been a while and not in the gambling side so much now Or if none of the above suit tell him bring it on pistols or swords at dawn
