Right, I've been looking at a 2 word domain name which is a well known dictionary phrase where surprisingly the .co.uk. is still available. Weirdly the guy (who has reg'd the .org.uk ext.) has TM'ed it in 6 categories but not reg'd it as a .co.uk! At the risk of sounding a little vague - worth a punt or leave well alone? :confused:

Maybe the couk was already regged at the time he was registering all the others.

Is he non profit? Alot of people simply dont care about the .co.uk if the org.uk is the "right" extension for them.
 
I would take a punt as trademarks don't bother me as much as most people.

I really think there is a way around lots of them.

Lots of trademarks if you look into can be a surname or a common phrase that is used regular.

As long as you don't use the domain to pretend to be someone your not or make money at the companys expense there are normally ways around this.

I have looked into this a lot lately and even seeked advice from a friend who knows a little about what you can and cannot do regarding legal issues.

I own a couple of trademark domains which of which one is a surnames in the BT Phone directory, and the other is a common phrase that could be used for lots of various websites.

I know that some may cause a few issues but if you are unsure and worried about it take a look into it before making your purchase.

As you have probably guessed I would take a punt, especially if it is one that you could use as a variation.

Are you looking to buy it to sell, or to use as a business? If its a completely different business to his then I wouldn't have thought it matters.
 
I take it you just "dropped on" the name while thinking out loud into the domain look-up.

I think I'd register it, and immediately try to sell it to the bloke (tell him you have just discovered his interests after registering it) for a "time and effort" fee, around £110.
If he doesn't want it, you could trade on it in any area not covered by his trademark. Just be sure that no-one else has covered other areas of that TM - that can happen sometimes.
