i am contact with a competitor (who is regulated)and if we can thrash out a suitable commission then if i have permission from them i can add the "representative of a regulated company" in the footer and they cannot touch me with a barge pole,if they persist i will contact the FSA for advice because i am only trying to earn a decent crust,i forgot to mention that they pulled me up because i had plagiarized there content basically i had the same header tag and keywords which was the name of the site which was clear using "copyscape"and they also had "rigorously protects its no 1 position by all means available" in the letter which i think was an extreme reaction

That was the mistake you made, and no wonder they are annoyed with you.
Put yourself in their shoes.

not in the content in the "meta tags"they was worried about having the same keywords in the meta data and effecting there seo,it was clear using copyscape and it's obvious that the header1 tag is the name of the site thats just good seo,if i had plagiarized content it would have come up as copied content

Did you copy their meta tags word for word or not?

i looked under google keyword tool for the highest concentration of searches in that field and cut and pasted them to the submitplus site and generated the meta data that way like i normally do,but yes the first six words were the same,i did research the topic and was influenced by all the sites on the first page of google,i am not whiter than white i have lifted sections from sites before if i am abit sketchy on the subject but i did spend a few days looking into the subject and got a working understanding of the topic before attempting to build a holding page/mini site,i didn't offer to sell anything and it was informative and yes it did have google ads on whilst i was finding an affiliate.it also had a privacy policy and site terms from the business link website.

I give up mate, this is so unclear. Up there you said:

..they pulled me up because i had plagiarized there content.....

And now you say all you've done is put the meta keywords together using the google keyword tool << If that's the case I don't see a problem, unless you've lifted their meta description and content from their site?

It's not a letter from a solicitor, it's from a competitor, so be suspicious of anything it says. As said in a previous post, the ASA would not be interested. I doubt any of the other organisations mentioned would be either. From what you have said it doesnt contravene Google's T&C.

On a side note, there are thousands of newspaper websites, national portals and the like which have financial sections with financial articles etc. They normally have a disclaimer on the page saying that the article is for informational purposes and does not constitute legal advice. Surely these are not registered with the FSA and they're openly admitting they're not offering professional financial advice. I would advise you to add a similar to the footer of each page.

If it were me, I'd either ignore them completely so as not to waste any time on them, or write a letter back telling them they should be ashamed of themselves for attempting to use such disgraceful, dishonest and underhand tactics. Either way, I'd reinstate the site and it would possibly spur me on to come up with a strategy to completely knock them off the first page of results.

Newspapers are a special case, the FSA allow them a degree of freedom not available to other sites.

When I write an article for a newspaper, I am regulated by the FSA, and the article has to be compliant, but the newspaper can write articles for publication and not require FSA registration.

....but yes the first six words were the same....

I would imagine that would be true for many sites in any small niche where people have done some SEO, if the words are relevant to the topic and not TM's or specific to the competitor in question then it sounds exactly like any decent SEO company would do for that niche.

I don't see any problems and I guess neither would the competitor if you were on page 59 of Google

I have had similar issues, 31 to date and counting, but hey my domain is the industry buzz after all.. I have had letters claiming to be from Solicitors (after research all faked) I have had claims of infringement.. again all unfounded.. I even have had begging letters and death threats for my domain..

One man called and told me that he was putting a hit out on me if I did not release the domain to his firm..

Needless to say... all very amusing, but at the same time the seriousness can not be ignored..

Obviously as I am writing here, the Hitman has not reached these shores yet..

The domain.. PPI Dot Co Dot UK of course.. now you can understand.. or maybe not.. eitherway.. if you want to know if what you are doing is right then go direct to the source..
