transferring a domain

Hi,

Some advice please.

I'm buying a domain, and there are two pages to the contract drawn up by their lawyers.

They want to transfer directly from a 123-reg account to my 123-reg account.

I'd prefer to go through Nominet, but the less fuss I make, the easier for the deal to go ahead!

Is it OK to just do a transfer from their 123-reg account to mine?
Will it automatically appear in my Nominet account?

In 123 reg if you goto the domain management, the click on contacts you do have the ability to change the Address and email address which does normally move the domain into a different Nom account by changing the email prior to an account to account transfer.

However they do not let you change the Name/registration via the contact page of the domain, so whether that happens with an actual account to account transfer i couldnt say.

Might be worth asking them, but even if you did do a 123 reg transfer, whats stopping you from just initiating a nom transfer if it is in your account still ? That way at least you waive complete responsibility after the sale is done.

Im sure if it was explained that if they dont do a nom transfer they dont really own the domain they wouldnt mind going through that extra click to accept the nom transfer and account setup.

If it's a deal big enough to involve lawyers, you should insist on a registrant transfer at Nominet.

Agree with the above - insist on a nominet transfer.

On a side note - earlier this year I agreed to purchase a domain (low-mid £xxx) from the administrators of a big company. They then said they wanted to me to cover the solicitor costs of around £1,000 to do a lease assignment!

I did this with a site I'd sold 5 year ago. The domain's been renewed twice since and is still in my nominet account.

I inquired about buying a domain under similar circumstances

They said their paperwork would cost £1000 then id have to agree the fee for the domain

It wasn't worth it

Basically the method they are suggesting will give you complete technical control over the domain but it will not update ownership. Always insist for a Nominet registrant transfer, it is the only way. (I know accredited registrars CAN update the legal registrant, but i don't know of any commercial registrars that will do this for you. You see some tag holders on here that will offer a push, this does work but certainly not through 123-Reg etc)

I have this problem when i sell domains too, a lot of buyers (or it's usually their "web guy" that thinks he knows best, the mere thought of suggesting anything other than what he says sends his blood pressure rocketing, veins popping out his head etc) insist on just updating the IPS TAG and leaving it at that, and I've actually lost a couple of sales from people taking the huff when i insisted on doing it properly not realising it was in their best interests.
